Last updated: April 1, 2026

1. Acceptance of terms

By accessing or using Audientia ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users globally. Additional terms may apply in certain jurisdictions as required by local law.

2. Description of service

Audientia is an AI-powered career preparation platform that provides:

  • Company intelligence reports generated using AI
  • AI-driven interview coaching with content, voice, and body language scoring
  • CV/resume review and analysis
  • Live job listing search

The Service is intended for personal career development use only. It is not a substitute for professional career counselling or legal employment advice.

3. Account registration

To use Audientia you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Be responsible for all activity that occurs under your account

You must be at least 16 years old to create an account. By registering, you confirm you meet this requirement.

4. Subscription plans and billing

4.1 Free plan

The free plan provides limited access to the Service at no charge. We reserve the right to modify or discontinue free plan features at any time with reasonable notice.

4.2 Paid plans

Paid subscriptions (Pro and Enterprise) are billed monthly in advance. Prices are displayed in AUD unless otherwise stated. We may change pricing with 30 days notice.

4.3 Cancellation and refunds

You may cancel your subscription at any time from your Settings page. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not provide partial refunds for unused time, except where required by applicable consumer law.

Australian users: Our refund policy does not exclude your rights under the Australian Consumer Law.

4.4 Payment processing

Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis. All transactions are subject to Stripe's terms of service.

5. Acceptable use

You agree not to use Audientia to:

  • Violate any applicable law or regulation
  • Impersonate any person or entity
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to reverse-engineer, scrape, or extract data from the Service
  • Use the Service to assist in fraudulent job applications or misrepresent your qualifications to employers
  • Resell, sublicence, or commercially exploit the Service without our written consent
  • Generate content that is defamatory, discriminatory, or harmful
  • Circumvent any rate limits, usage restrictions, or security measures

6. AI-generated content

Audientia uses large language models (including OpenAI's GPT-4o) to generate company reports, interview questions, coaching feedback, and CV analysis. You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or outdated information
  • Company intelligence reports are based on publicly available information and AI training data — they are not guaranteed to be current or accurate
  • Interview coaching feedback is for practice purposes only and does not guarantee employment outcomes
  • CV feedback is advisory only and should be reviewed by a qualified professional before submission to employers

You are responsible for verifying any information before relying on it for employment decisions.

7. Intellectual property

7.1 Our intellectual property

The Audientia platform, including its design, code, branding, and AI-generated outputs, is owned by or licensed to us. You may not copy, reproduce, or create derivative works without our written permission.

7.2 Your content

You retain ownership of content you submit (such as interview responses and CV text). By submitting content, you grant us a limited licence to process it solely to provide the Service to you. We do not use your content to train AI models.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.

Australian users: Nothing in these Terms excludes guarantees or warranties implied by the Australian Consumer Law that cannot be excluded by contract.

10. Limitation of liability

To the fullest extent permitted by applicable law, Audientia and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or employment opportunities, arising from your use of the Service.

Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Audientia and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from Settings.

13. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

For users in the EU/EEA, you may also bring claims in the courts of your country of residence.

We encourage you to contact us first at legal@audientia.com to resolve any dispute informally before initiating legal proceedings.

14. Changes to terms

We may modify these Terms at any time. We will notify you of material changes by email or via a notice on the Service. Continued use after the effective date of changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
